Terms of Service
These Terms of Service (“Terms”) govern your access to and use of Emit, the
RSS-to-newsletter service available at rssemit.com and the
API at api.rssemit.com (the “Service”), operated by
Helton Labs LLC
(“Helton Labs,” “we,” “us”). By creating an account or using the Service, you agree to these
Terms.
1. The Service
Emit polls RSS/Atom feeds you connect and sends the resulting emails to subscribers you supply, on your behalf, from a sending domain you control and verify. You are responsible for the content of your feeds and emails and for the subscribers you add.
2. Accounts and API keys
You are responsible for safeguarding your API key. The key is shown once at creation and is
not recoverable; you can rotate it via POST /v1/account/rotate-key. You are
responsible for all activity under your account. You must provide accurate account
information and be at least the age of majority in your jurisdiction.
3. Acceptable use
You agree not to use the Service to:
- send unsolicited bulk email (“spam”) or email to recipients who have not opted in;
- violate the CAN-SPAM Act, GDPR, CASL, or any applicable anti-spam, privacy, or data-protection law;
- send unlawful, deceptive, infringing, or harmful content, or content you lack rights to;
- omit a functioning unsubscribe mechanism or send to addresses that have unsubscribed;
- attempt to circumvent rate limits, sending caps, suppression handling, or domain verification;
- resell the Service or use it to compromise its security or another party’s systems.
You must honor unsubscribe and suppression signals. We may suspend or terminate accounts that harm deliverability or violate these Terms, and may suppress addresses that bounce or complain.
4. Billing and credits
The Service is prepaid. You purchase credits (1 credit = 1 email) via our payment processor; a credit is consumed only on a delivery attempt. Pricing is published at rssemit.com/#pricing and may change with notice. Credits do not expire. Except where required by law, purchased credits are non-refundable; we may, at our discretion, refund an unused prepaid balance on account closure.
5. Your content and data
You retain all rights to your feeds, email content, and subscriber lists. You grant us a limited license to process and transmit that content solely to provide the Service. Our handling of personal data is described in our Privacy Policy, which forms part of these Terms. With respect to your subscribers’ personal data, you are the controller and we act as your processor.
6. Third-party services
The Service relies on third parties including Amazon Web Services (SES), Resend, Stripe, and our hosting provider. Your use is also subject to their terms where applicable.
7. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation, or any particular deliverability or inbox placement rate.
8. Limitation of liability
To the maximum extent permitted by law, Helton Labs will not be liable for any indirect, incidental, special, consequential, or punitive damages, or lost profits or revenues. Our total liability for any claim arising out of or relating to the Service is limited to the amounts you paid us in the three (3) months preceding the event giving rise to the claim.
9. Termination
You may close your account at any time. We may suspend or terminate access for violation of these Terms or to comply with law. Sections that by their nature should survive termination will survive.
10. Changes
We may update these Terms; material changes will be posted here with an updated date. Continued use after changes constitutes acceptance.
11. Governing law
These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict-of-laws rules. The exclusive venue for any dispute shall be the state and federal courts located in Georgia.
